Legitimation: The legitimacy for processing your data to create a user account is based on your consent, as well as the need to execute the contractual relationship established between you and Kave Home when placing orders through the Platform.

 

With regard to sending satisfaction surveys, the legal basis that legitimises such processing is the legitimate interest of Kave Home, in accordance with the provisions of article 6.1.f) of the GDPR, to evaluate and improve the quality of the service offered.

 

In addition, we consider that Kave Home has a legitimate interest in carrying out the necessary checks to prevent and detect possible fraud or misuse of the Platform. In this regard, we expressly inform you that, in accordance with the provisions of the GDPR, Kave Home has previously carried out an internal proportionality assessment to ensure that our legitimate interests prevail over your fundamental rights and freedoms. This assessment ensures that processing operations based on legitimate interest do not adversely affect your interests, fundamental rights or individual freedoms.

 

We inform you that you do not need be registered as a user to make a purchase on our Platform. You may purchase products as a guest by providing only the data necessary to process the order, send the shipment and comply with the legal obligations arising from the transaction.

 

Storage: Your data will be kept for as long as your account is active or we have a contractual relationship with you. This includes using our Platform to make purchases, contract services or make payments without registration. We offer different programmes and spaces for collaboration with professionals, content creators or those interested in job opportunities, each with specific purposes and different legitimisations:

 

-                 Work with us: Your curriculum vitae, applications and cover letters shall be processed for the purpose of managing our job vacancies. This processing is based on the consent you give when you apply to participate in our recruitment processes.

 

-                 Collaborate with us/Join us: If you contact us for a collaboration or to participate in the Kave Affiliates programme, we will process your data for the purpose of managing your collaboration as an influencer or brand ambassador. This processing is also legitimised by your consent.

 

-                 KAVE Partner/KAVE PRO: The data provided in this context shall be used to establish and manage a professional or commercial relationship with you. This processing is based on your consent, the need to execute a contract and our legitimate interest in maintaining effective business relations.

 

-                 Suppliers: The data collected through the "Suppliers" section shall be processed in order to manage commercial relations, on the basis of the consent given when filling in the corresponding form.

 

Storage: Candidate information and CVs will be kept for a maximum of 2 years from when they are received, unless you inform us otherwise.

 

In the case of business relationships or active collaborations, the data will be kept for the duration of the relationship or as long as there is a need to keep the data for legal or contractual reasons.

 

4.3.             Marketing and commercial communications (newsletter)

 

Purpose: We process your personal data to send you personalised commercial communications through different channels, such as email, SMS or instant messaging, provided you have given your consent to receive them.

 

If you have subscribed to our newsletter, we will use your data to manage your subscription and keep you informed about news that may be of interest to you. You may revoke your consent at any time and request to not be sent commercial communications easily and free of charge. Your cancellation request will be processed within 72 hours of receipt.

 

Storage: Your data will be kept for as long as you keep your subscription active. If you request to unsubscribe, we will delete or block it in accordance with the regulations in force.

 

4.4.             Participation in events and promotions

 

Purpose: We process your personal data to manage your registration and participation in exclusive events, special promotions or campaigns organised by Kave Home.


We will use your data to confirm your attendance at events organised by Kave Home, send you relevant information about promotions, activities or dynamics linked to the event, and communicate with you before, during and after the event, if necessary.


Legitimation: The legal basis for this processing is the data subject's express consent, which is clearly granted when filling in the registration form on the website or scanning a QR code in the shop.

 

Storage: Data will be kept for the time needed to manage your participation and to handle with any claims, after which the legal limitation periods shall apply.

 

4.5.             Gift card management

 

Purpose: We process the personal data necessary to manage the full purchase, delivery and redemption process for gift cards purchased through our Platform.

The data is used exclusively to process the purchase made by the buyer, to send (where applicable) the gift card to the indicated recipient, and to manage the use and redemption of the card in accordance with the stipulated conditions.


Legitimation: The processing of the data is based on execution of the contract arising from the gift card purchase, and on the fulfilment of the conditions of use accepted by the buyer upon completing the purchase.


In any case, the buyer undertakes to inform the gift card recipient about the processing of their personal data in accordance with this policy. This ensures transparency and compliance with the data protection regulations in force.

 

Storage: The buyer's and recipient's data will be kept for as long as they are necessary to manage the card and comply with legal and fiscal obligations.

 

4.6.             Interior design services

 

Purpose: To offer a comprehensive and quality experience when hiring our interior design service, we process your personal data with the maximum guarantees of confidentiality and in accordance with current legislation.

 

Your data will be used to manage and improve the interior design service hiring process, to coordinate the execution of the project (communication with the client, planning of visits, deliveries, etc.) and to process the payments associated with the service.

 

Legitimation: The processing of the data is based on execution of the contract arising from purchase of the service, and on your express consent, given by voluntarily providing your data on the relevant form.

 

Storage: Your data will be kept for the duration of the service and thereafter for as long as necessary to meet legal liabilities.

 

4.7.             Customer service and service improvement

 

Purpose: At Kave Home we only process the personal data that is essential to effectively handle your request, query or demand, always ensuring appropriate and proportional processing.

 

If you choose to contact our Customer Service team via a social network chat service, some of your personal data, such as your name, username or email address, may be automatically imported from your account on the platform.

 

In addition, please note that the information you share in the chat may also be accessible to the provider, and shall be subject to its own privacy policies and terms of use.

 

If you contact us by telephone, the call may be recorded to guarantee good customer service.

Storage: The recordings will be kept for a period limited to six months. Unless legal circumstances justify a longer period, they shall only be accessible to authorised personnel and shall not be used for purposes other than those stated herein. All technical and organisational measures necessary to protect their confidentiality shall be implemented.

 

4.8.             Management of the whistleblower channel

 

Purpose: Kave Home provides its employees, collaborators and other stakeholders with a confidential whistleblower channel that allows any irregularity, breach of regulations or behaviour contrary to the company's ethical, legal and integrity principles to be reported anonymously or not.

 

This channel is part of Kave Home's commitment to transparency, corporate responsibility and ethical culture at all levels of the organisation.

 

The data is collected through the whistleblower channel form, which offers the option to make anonymous reports. For complaints that are not anonymous, the first name, surname, e-mail address and incident details will be processed. In anonymous reports, only the incident details will be collected, the whistleblower’s personal details will not be collected.

 

Legitimation: The processing of personal data related to the whistleblower channel is based on compliance with legal obligations regarding compliance and crime prevention, as well as the legitimate interest of Kave Home in detecting, preventing and correcting possible risks, irregularities or internal offences. This interest includes communicating data to the company responsible for the implementation and technical maintenance of the digital whistleblower channel, which acts as the data processor.

 

Storage: The data will be kept only for as long as it is necessary for the purpose of handling and investigating the complaint. The data may then be blocked or anonymised, in accordance with the law.

 

4.9.             Financing of purchases

 

Purpose: If you request financing when making your purchase through our Platform, Kave Home may act as data processor, collecting and transferring your personal data to Banco Cetelem, S.A.U., a financial entity that shall assume the role of data controller from the moment it receives said information and which shall apply its own privacy policies, which you may consult at: https://www.cetelem.es/proteccion-de-datos.

 

The purpose of this data processing is to comprehensively manage your financing request, which may involve the following: verification of the apparent authenticity of the identity documentation submitted, transmission of the necessary information to Banco Cetelem, S.A.U., so it may assess the application and, where appropriate, approve the financing and facilitate signing and execution of the financing contract if the transaction is accepted.

 

Legitimation: The processing of personal data is legitimised by the execution of pre-contractual measures at the request of the interested party, or the formalisation of the financing contract, with Banco Cetelem, S.A.U. as the recipient of the data and the data controller having received said data.

 

Storage: The data will be kept while your application is being assessed. If approved, Banco Cetelem, S.A.U. will keep the data according to its own terms and privacy policies, becoming the data controller from the moment the data is received.

 

4.10.         Website browsing and usability analysis
